Getting Married in Australia When You Live Overseas

You do not need to be an Australian citizen or permanent resident to marry in Australia. That makes Australia a welcoming place for visitors, couples who live overseas and people returning home to celebrate with family. The legal process is still Australian, so build time into your plans.

Start with an authorised celebrant

Choose an authorised marriage celebrant early and explain where each of you is living. You can complete the Notice of Intended Marriage while overseas if you plan to marry in Australia, but it must be given to the celebrant within the legal timeframe: at least one month and no more than 18 months before the wedding.

Plan documents before flights

Your celebrant will need evidence of your date and place of birth, identity and the end of any previous marriage if relevant. Give them time to check whether overseas documents or translations need further attention. This is especially important when names differ across documents or a divorce was granted in another country.

Know what can happen remotely

The NOIM can be witnessed remotely in certain situations, but the rules are location-dependent. Ask your celebrant before arranging a video appointment. Before the marriage is solemnised, the celebrant must meet separately and in person with each person, so factor that meeting into your travel schedule.

Marriage is not a visa pathway by itself

A lawful Australian marriage does not automatically give anyone a visa or a right to live in Australia. If migration is part of your plan, get independent immigration advice from the appropriate government service or a qualified professional. Keep the legal marriage process and visa process distinct.

With a clear timeline and responsive communication, a destination wedding can be both beautifully personal and legally uncomplicated.
